Kinder Surprise chocolate eggs to be banned in Germany

I used to bring some Kinder eggs with me to give to relatives on trips home to Minnesota because I had heard they weren't available in the USA. Is that still true? I can understand that they do present a choking hazard if given to very young children but older children (and some adults!) love collecting the Kinder Surprise toys that come with the chocolate.
